CONTESTED DIVORCES

A Contested Divorce occurs when spouses are unable to agree on every issue to settle a divorce. We will zealously represent you in a contested divorce. Cordts & Gulley, PLLC, has the experience, resources, and knowledge to advise you how to handle financially complex divorce issues, including the following:

  • Pensions and Retirement Plans including division of 401Ks and IRAs
  • Stock options
  • Investment Portfolio division
  • Military Retired Pay and Benefits
  • Small Business Valuations
  • Real Estate – including quitclaim deeds to transfer property
  • Debt division
  • Bankruptcy issues related to divorce

UNCONTESTED DIVORCES

Uncontested divorces are those in which all issues, including shared parenting time, child support according to the Tennessee Guidelines and property and debt issues can be agreed on. We can assist you with making informed choices and help you determine if your agreement is sound before you formally enter into it. Our firm encourages amicable agreement between divorcing spouses when possible. Our goal is to minimize stress and expense in all divorces.

SHARED PARENTING (FORMERLY CHILD CUSTODY)

Shared parenting time is the most important issue in any divorce or other case involving children. We advise clients that the “Best Interests of the Child” should always come first. Our firm can assist you with the difficult issues and decisions about your children whether it is representing you in court or creating a Permanent Parenting Plan to help settle these often contentious issues.

CHILD SUPPORT

Child support guidelines have recently been changing quickly and often, and our firm focuses the time and attention necessary to assist you with a fair calculation of child support. No two cases are generally alike, and we can look at all the variables under the guidelines to see what best fits your situation.

MODIFICATION

Our firm can advise you on the most cost efficient ways to modify an existing court order, such as Final Decree of Divorce or a Permanent Parenting Plan or Child Support Order.

CONTEMPT ACTIONS

Sometimes a party fails to comply with a court order, which can amount to Contempt of Court. Contempt of Court can be civil and, in some cases, criminal in nature. We can represent you against a party who fails to comply and help you enforce the order. Conversely, we can defend you if you are charged with failing to comply with an order of the Court.

ADOPTIONS

Our firm can advise and guide you through the often complex process of adoption, whether you are a stepparent seeking an action to terminate the rights of a biological parent to adopt a stepchild, a family member seeking to adopt a related child, or a potential parent seeking a traditional agency adoption.

MILITARY ASPECTS OF DIVORCE

We will help you with issues concerning military retirement as it relates to the divorce. This area is complex, and we can guide either side toward a fair resolution based on your individual facts. We can also assist you with putting together the proper order and sending the proper documentation to the government if you qualify through court order or agreement to receive a portion of a spouse’s military retired pay.

MEDIATION SERVICES

We can represent you during a divorce mediation proceeding to ensure you get what you bargain for and review any agreements before they are formalized. Coming in 2007, Cordts & Gulley, PLLC, anticipates being able to offer Divorce Mediation Services using a Tennessee Supreme Court Rule 31 Listed Mediator. Mediation is increasingly helpful in resolving many of the contentious issues in divorce.
